Terms of Service

These Terms of Service (“Terms”) govern your use of addresspops.com and the services provided by Address Pops (“we,” “us,” “the studio”). By engaging us for a launch or using this site, you agree to these Terms.

1. The service

Address Pops designs and produces dedicated digital launches (“Pops”) for individual real-estate listings: a custom-designed website for one property, together with the associated art direction, copywriting, domain configuration, and hosting for the term described below. The scope of each engagement is the scope stated in your written proposal or order confirmation.

2. Engagement and approval

Work begins when we confirm your brief and receive your property assets. We deliver a private preview for your review. Each engagement includes two rounds of revisions unless otherwise agreed in writing. Your written approval of the preview constitutes acceptance of the deliverable.

3. Payment

For engagements sold on “pay only when you love it” terms, no payment is due until you approve the preview; upon approval, payment is due in full before the Pop goes live. For all other engagements, payment terms are as stated in your proposal. Prices are in U.S. dollars and exclusive of any applicable taxes.

4. Client responsibilities

• You confirm you hold the rights (or the listing authority) to the property information, photography, video, and other assets you supply.
• You are responsible for the accuracy of listing facts - price, dimensions, features, and representations - and for compliance with MLS rules, brokerage policies, fair-housing laws, and advertising regulations applicable to you.
• You will review the preview and final Pop for accuracy before approval.

5. Intellectual property

You retain all rights to the assets you supply. Upon payment in full, you receive a perpetual license to the delivered Pop for the marketing of the property and of your own practice. We retain ownership of our underlying design systems, templates of our own making, processes, and tooling, and we retain the right to display the delivered work in our portfolio, showcase, and marketing - including the Pop's serial designation - unless we agree otherwise in writing.

6. Hosting and term

Each Pop includes hosting and domain configuration for the life of the listing, up to twelve (12) months from launch unless otherwise agreed. Extensions and archival options are available on request. We may perform maintenance that briefly interrupts availability; we will keep such interruptions to a minimum.

7. Founding engagements

Founding-rate engagements are limited in number, numbered publicly, and offered in exchange for reasonable case-study participation: a testimonial, permission to feature the work, and availability as a reference. These are a condition of the founding rate.

8. Warranties and disclaimers

We warrant that the work will be of professional quality and delivered with reasonable skill and care. We do not warrant any particular commercial outcome - including inquiries, showings, offers, sale price, or time on market. Except as expressly stated, the service is provided “as is.”

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to an engagement is limited to the amount you paid us for that engagement. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost opportunities.

10. Termination

You may end an engagement before approval at no charge. We may decline or end an engagement at our discretion (for example, where assets or representations appear inaccurate or unlawful); if you have paid and we end the engagement without delivery, we will refund you in full.

11. General

These Terms are governed by the laws of the State of California. If any provision is found unenforceable, the remainder stays in effect. We may update these Terms from time to time; the version on this page applies. Questions: hello@addresspops.com.
